General Terms and Conditions
for the Goldener Papagei online shop
1 Scope and Provider
These General Terms and Conditions apply to orders placed via the online shop operated by GPARG4 GmbH. Provider and contracting partner is GPARG4 GmbH, Argentinierstraße 4–6/Lokal, 1040 Vienna, Austria, FN 657586p, Commercial Court Vienna, Email: hello@goldenerpapagei.live.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional. An entrepreneur is anyone who acts in the exercise of their commercial or independent professional activity.
2 Offer and Conclusion of Contract
The presentation of products in the online shop constitutes a non-binding invitation to place an order. Before submitting, the customer can check and correct their entries. By pressing the final order button clearly marked as requiring payment, the customer submits a binding offer. An automated confirmation of receipt merely confirms receipt and does not constitute acceptance unless explicitly stated. The contract is concluded by a separate declaration of acceptance, dispatch confirmation, or actual execution of the order. We may reject an order, in particular in the case of non-availability, obviously incorrect price information, unsuccessful payment, justified suspicion of fraud, unusual order quantities, or an undeliverable address. Amounts already collected will be refunded immediately in this case.
The contract language is German. Order data and contract information are stored in accordance with statutory requirements and provided to the customer by email or on another durable medium.
3 Products and Availability
Decisive are the product description and the characteristics displayed at the time of ordering. Illustrations may differ due to screen and device settings. Coffee and other natural products may show minor, product-typical variations in color, shape, size, scent, and taste depending on harvest, processing, and roasting; statutory warranty rights remain unaffected. Quantities are limited to customary household orders unless offered otherwise in the online shop. If a product is not available despite careful disposition, we will inform immediately and refund payments already made. A claim for replacement delivery exists only under the statutory requirements.
4 Prices, Discounts, and Shipping Costs
All prices displayed in the online shop are total prices in euros including the applicable value added tax. Shipping costs and other unavoidable additional costs are displayed before the order is placed. The prices displayed at the time of order are decisive. Obvious entry, calculation, or system errors entitle us to reject the offer; an already effectively concluded contract remains to be assessed according to statutory rules. Discounts are applied in the sequence displayed in the checkout. Free shipping thresholds relate to the value of goods after deducting all discounts and before shipping costs.
5 Payment
The payment methods displayed in the checkout are available. The total amount is generally due upon conclusion of the contract. For coffee subscriptions, the billing rules in Section 13 apply additionally. Payment processing is handled via Shopify Payments or the payment service provider selected in the checkout. If a payment is rejected, charged back, or not executed on time, we may withhold performance until full payment and withdraw from the contract after a reasonable period, as permitted by law. Third-party costs incurred through chargebacks or similar events attributable to the customer may be charged in the actual, reasonable amount incurred; the customer retains the right to prove lower damage.
6 Delivery
We deliver exclusively to the countries selectable in the checkout and up to the weight limits specified there. Estimated delivery times are specified in the shipping information and, unless stated otherwise, begin upon dispatch of the goods. Delivery dates are binding only if expressly confirmed as binding. Partial deliveries are permissible if reasonable for the customer; no additional shipping costs arise thereby.
Additional costs attributable to the customer due to an incomplete or incorrect delivery address, unjustified refusal of acceptance, or failure to pick up a shipment in time may be charged in the actual, reasonable amount incurred. Statutory rights of revocation, warranty, and default remain unaffected. For consumers, the risk of accidental loss or accidental damage generally passes only upon handover to the consumer or a third party designated by them.
7 Retention of Title
The goods remain our property until full payment.
8 Right of Withdrawal
Consumers are fundamentally entitled to the statutory right of withdrawal. Conditions, deadlines, consequences, exceptions, and the unchanged statutory model withdrawal form can be found on the "Withdrawal and Returns" page. Additionally, the easily accessible electronic function "Cancel contract" is available in the online shop. Statutory exceptions apply only if their prerequisites are met in the specific case.
9 Warranty
Statutory warranty provisions apply, in particular the Consumer Warranty Act and the General Civil Code. Consumers may assert statutory rights in the event of defects. An additional manufacturer guarantee exists only if explicitly specified for the respective product.
10 Liability
Towards consumers, we are liable according to statutory provisions. Towards entrepreneurs, liability for slightly negligent property and financial damage is excluded; in the event of slight negligence violating an essential contractual duty, liability is limited to foreseeable, contract-typical damage at the time of contract conclusion. These limitations do not apply to personal injury, intent, gross negligence, fraudulent concealment, expressly assumed guarantees, or claims under product liability law. For disruptions or failures of Shopify, payment, shipping, or other third-party services, we are liable only to the extent that our own fault applies; mandatory statutory rights remain unaffected.
11 Gift Cards / Vouchers
Goldener Papagei value vouchers issued by GPARG4 GmbH can be redeemed in the online shop and at participating Goldener Papagei locations operated by GPARG4 GmbH according to the terms specified on the voucher. Partial redemption is permissible; remaining balance remains valid until the next redemption. Cash payout, interest, or payout of remaining amounts is excluded unless mandatory law provides otherwise. In the event of loss or unauthorized use of a transferable voucher, there is generally no entitlement to replacement unless the voucher could be technically blocked in time. Statutory limitation periods remain unaffected.
12 Promotional Codes and Newsletter Discount
Promotional and discount codes apply only within the specified period and for the designated products. They are not redeemable for cash and generally cannot be combined with each other. Upon confirmed newsletter registration, a one-off discount code of 10 percent for the first order is provided. This is valid for 30 days from sending, usable only once per customer and email address, and does not apply to value vouchers, coffee subscriptions, shipping costs, or already reduced products. Generally, only one promotional code can be used per order unless explicitly stated otherwise in checkout. In the event of contract cancellation/reversal, there is no entitlement to reissue a used promotional code unless the cancellation was our responsibility.
13 Coffee Subscriptions
Coffee subscriptions are available for the coffee varieties and package sizes designated in the online shop with delivery intervals of 2, 4, or 8 weeks. The subscription price corresponds to the price displayed in checkout and contains a 10 percent price advantage over the regular single purchase price displayed there. Shipping costs apply to every individual delivery according to the applicable shipping conditions; for free shipping thresholds, the value of goods after deducting the subscription discount is decisive.
The subscription begins with the first order and continues without a minimum contract term until cancellation. For follow-up deliveries, billing and binding order creation take place every Sunday at 23:59; the regular shipping day is Tuesday. Changes, pauses, skipping individual deliveries, or cancellations must be received by Sunday at 23:59 via the customer portal or by email to hello@goldenerpapagei.live to cover the immediately following delivery. Later declarations apply to the subsequent delivery. Already billed orders remain payable and will be shipped unless statutory withdrawal or other mandatory rights apply.
The customer authorizes the selected payment service provider to automatically charge the amounts due for each follow-up delivery via the stored payment method. If payment fails, we may make further collection attempts, withhold delivery, and terminate the subscription after reasonable notice.
We may adjust subscription prices for future, not yet billed deliveries if verifiable procurement, energy, packaging, shipping, tax, or duty costs change after conclusion of contract. Cost reductions will be passed on according to the same standards; the adjustment must not be used to generate additional profit increases. We will inform at least 30 days before taking effect. The customer may cancel the subscription free of charge until the change takes effect.
14 Copyrights
Texts, images, trademarks, designs, and other content of the online shop are protected by law. Any use outside statutory limits requires the prior consent of the respective rights holder.
15 Applicable Law and Place of Jurisdiction
Austrian law applies under exclusion of the UN Sales Convention. For consumers, this choice of law applies only insofar as mandatory protection of the state of their habitual residence is not withdrawn. Statutory places of jurisdiction apply to consumers. For entrepreneurs, the court with subject-matter jurisdiction at the registered office of GPARG4 GmbH is agreed, to the extent permitted.
16 Dispute Resolution
We are generally not obligated and currently not willing to participate in dispute resolution proceedings before a consumer arbitration board, unless explicitly agreed otherwise in individual cases. The former European Union Online Dispute Resolution platform has been discontinued.
17 Final Provisions
Should individual provisions be invalid, the remaining provisions remain unaffected. Towards consumers, statutory regulations replace an invalid provision. A waiver of rights requires an explicit declaration; mere non-exercise does not constitute a waiver. Status: September 4, 2026.
